Clutch issue and a short story ('04 5 speed GLS)

** 2004 Hyundai Elantra GLS 5 speed 126,700 miles **

I am a new owner of my first Hyundai and although Ive only driven it 70 miles, I LOVE it!

I bought it from a older fellow that stated he has done a lot of work to it, one of them including a 'newer' clutch. I test drove it around the city reaching up to 45 mph in 5th gear, hard and slow acceleration and noticed no big issues.

Driving it home on the highway though I noticed the clutch was slipping. I brushed this off because I know a new clutch needs a few hundred miles to break in, I was feeling pretty good about it!

Driving through my local city, i noticed some occasional slipping here and there and began to get weary..

Then... I get home.. and it smelled like the car was burning a little. I am not familiar with the smell of a burning clutch.

Going off a hunch a popped the clutch in 3rd gear at a standstill.. and TADA!! the car stayed on at ~700rpm. Now, it will hardly even move. I can take it around the block but even inching on the pedal makes it slip. I live on a hill and after parking it facing up the hill, I can't get it to move forward.

Its a very mild incline but enough to be a hill none the less.

I contacted the owner and he said he had to bleed the system a few times because it was doing that.. but he lied to my face during the purchase so I am coming to an experienced forum now.

He also told me during the purchase that he had replaced the clutch claiming 'he does this kind of thing for a living', but after confronting him with this issue, he stated it was replaced by someone else.

Has anyone experienced this issue with their elantra or any other 5 speed?

I would also like to mention that we checked the clutch fluid reservoir and it is a little below the full line. The lines aren't leaking anywhere and the slave cylinder is mostly dry.

Side note, I am going to get it inspected by a mechanic tonight and if the issue is the clutch, I will be taking this man to court for the expenses. I had my new born in this car and if his greed for money and blatant disregard for the safety of my family is true, I'll be sure I at least get him to pay for every last thing wrong with the car until it is in a shape that we could all agree is safe.
